These terms apply to every sale of Desi Kothi Ice Cream products to retailers, restaurants, ice cream parlours and other business customers. By placing an order, you agree to these terms.
Orders can be placed by phone, email or through your Desi Kothi representative. An order is confirmed once we acknowledge it. We will let you know as soon as possible if any product is unavailable, and may offer a suitable alternative.
Prices are as shown on your current Desi Kothi price list or quote and are in Australian dollars. Prices may change from time to time; any change will be communicated before it applies to new orders.
We deliver using frozen transport to keep products at –18°C or colder. Someone must be available to receive and inspect each delivery and move the products into frozen storage straight away. Risk in the products passes to you on delivery.
Invoices must be paid in full within the agreed timeframe. A 3% late payment fee applies for every week a payment remains overdue. We may pause deliveries while invoices are overdue, and repeated late payments may move your account to Cash on Delivery (COD). Unpaid invoices more than three weeks overdue may be referred to debt recovery, with the associated costs payable by the customer. No deductions may be made from an invoice without our written consent.
Please check every delivery on arrival. Any problem with a delivery must be reported within 24 hours, with photos and a description of the issue. Invoice disputes must be raised within 48 hours of receipt; undisputed amounts remain payable on time. Only products damaged in transit, or by events outside your control, qualify for replacement. Products in good condition cannot be returned.
Once delivered, products must be stored between –18°C and –20°C in properly working freezers. We are not responsible for product quality issues caused by incorrect storage or handling after delivery.
Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot be excluded.
